Creator Program Agreement

1. Overview

The Tamu Creator Program ("Creator Program") is an opt-in monetisation system that allows eligible users ("Creators") to earn revenue through branded campaigns, tips, virtual gifts, and other monetisation features available on the Tamu platform ("Platform"). This Creator Program Agreement ("Agreement") is a legally binding contract between you and Tamu Technologies Ltd ("Tamu", "we", "us"). It supplements and is incorporated into the Terms of Service and Wallet & Virtual Currency Terms. By enrolling in the Creator Program you confirm that you have read, understood, and agree to this Agreement in full.

2. Eligibility

To enrol in and remain in good standing with the Creator Program, you must at all times satisfy each of the following conditions:

  • Age: You must be at least 18 years of age. We may request identity documents to verify this at any time.
  • KYC Approval: You must successfully complete Tamu's Know Your Customer ("KYC") verification process, which includes providing a valid government-issued photo ID and, where required by law, proof of address. KYC is mandatory before any payout can be processed.
  • Payout Method: You must have a verified payout method on file (M-Pesa, bank transfer, or other supported rail) that is registered in your own name.
  • Monetisation Agreement: You must have accepted this Agreement and any supplemental monetisation policies in force at the time of your application.
  • No Fraud Holds: Your account must not have any pending fraud investigation, active suspension, or unresolved dispute relating to financial misconduct.
  • Good Standing: Your account must comply with our Community Guidelines and all applicable laws in your jurisdiction.

Tamu reserves the right to revoke Creator Program access at any time if eligibility conditions are no longer met.

3. Monetisation and Revenue

The following revenue-share rates apply to monetisation features available to Creators. All figures are subject to change with 30 days' notice.

  • Brand Campaigns: Creators receive 70% of Net Campaign Revenue. "Net Campaign Revenue" means the total value of a campaign brief minus any applicable taxes collected at source and any third-party transaction fees. Tamu retains a 30% platform fee.
  • Tips & Virtual Gifts: Creators receive 70% of the coin value of tips and gifts received, converted at the prevailing coin cash-out rate at the time of settlement. Tamu retains a 30% platform fee.
  • Coin Cash-Out Rate: The conversion rate between Tamu coins and local currency is published in the Wallet section of the app and may be updated periodically. The rate applicable at the time a withdrawal is requested is the rate used for that transaction.
  • Other Features: Revenue terms for any additional monetisation features (e.g. paid subscriptions, live events) will be disclosed to you before those features are enabled on your account.

4. Marketplace Campaigns

Tamu operates a Creator Marketplace where brands and advertisers ("Advertisers") can brief Creators directly for sponsored content campaigns.

  • Campaign Offers: When an Advertiser selects you for a campaign, you will receive a campaign brief detailing deliverables, deadlines, brand guidelines, and the agreed campaign fee. You must explicitly accept or decline an offer within the timeframe stated in the brief (default: 48 hours). Silence does not constitute acceptance.
  • Delivery Obligations: Upon acceptance you are contractually obligated to deliver the specified content by the stated deadline. Late or non-delivery may result in campaign cancellation, recovery of escrowed funds to the Advertiser, a reduction in your Creator Score, and potential suspension from the Marketplace.
  • Brand Guidelines: Branded content must comply with the Advertiser's brand guidelines as communicated in the brief. You must not alter, remove, or obscure required brand disclosures, logos, or messaging without prior written approval from Tamu or the Advertiser.
  • Disclosure: All sponsored content must be clearly labelled as such using Tamu's built-in sponsored-content tag. Failure to disclose sponsorship may violate applicable advertising regulations and may result in campaign disqualification.
  • Moderation: Tamu moderates submitted campaign deliverables before releasing escrowed funds. Content that does not meet the brief or violates platform policies will be rejected, and you will be given a single opportunity to resubmit within 24 hours.

5. Payout Terms

  • Minimum Withdrawal: The minimum amount you may withdraw from your Creator Balance in a single transaction is USD 10 (or the local currency equivalent at the prevailing rate).
  • Request Frequency: You may submit one payout request per 24-hour period.
  • Reserve Policy: Tamu holds a 10% rolling reserve from each earnings settlement. Reserved funds are released 30 days after the date of the corresponding transaction, subject to no disputes or fraud flags being raised during that period.
  • KYC Requirement: Payouts will not be processed until KYC verification is complete and approved. Funds earned prior to KYC completion will be held and released upon approval.
  • Payout Rails: Funds are disbursed via real payment rails (M-Pesa, bank transfer, or other supported methods) to the verified payout method on file. Tamu does not pay out in cryptocurrency or gift cards.
  • Processing Time: Approved payouts are typically processed within 1–5 business days, depending on your payout method and jurisdiction. Processing times may be extended during high-volume periods or for additional compliance checks.
  • Fees: Tamu does not charge a processing fee for standard payout methods. Third-party fees imposed by your bank or mobile money provider are your responsibility.

6. Creator Score

Your Creator Score is a dynamic quality signal computed by Tamu's systems. It affects your visibility in the Creator Marketplace and may influence the campaign rates you are offered.

The Creator Score takes into account, among other signals:

  • Campaign Completion Rate: The percentage of accepted campaigns you have delivered on time and to the brief.
  • Engagement Quality: Authentic engagement rates on your content, assessed for signs of artificial inflation.
  • Dispute History: The number and severity of disputes raised by Advertisers or resolved against you.
  • Response Time: How quickly you respond to campaign offers and Advertiser messages.

A declining Creator Score may result in reduced Marketplace visibility, removal from premium campaign pools, or temporary suspension from the Creator Program. Tamu does not guarantee any particular level of campaign volume or revenue as a result of your Creator Score.

7. Prohibited Conduct

The following conduct is strictly prohibited and may result in immediate termination of your Creator Program access and forfeiture of outstanding balances:

  • Fake Engagement: Purchasing, soliciting, or artificially inflating views, likes, comments, followers, or any other engagement metric.
  • Self-Tipping: Tipping your own account directly or indirectly using any device, account, or network.
  • Circular Gifting: Coordinating with other users to exchange gifts in a pattern designed to extract platform value without genuine appreciation.
  • Fraudulent Brand Deals: Accepting a campaign without intending to deliver, submitting non-compliant deliverables knowingly, or colluding with an Advertiser to create fictitious campaigns.
  • Impersonation: Misrepresenting your identity, reach, or credentials to Advertisers or Tamu.
  • Any other conduct that Tamu reasonably determines to constitute fraud, abuse, or exploitation of the Creator Program.

8. Termination

Tamu may suspend or terminate your participation in the Creator Program at any time, with or without prior notice, if:

  • You violate this Agreement or any Tamu policy;
  • You engage in any form of fraud, abuse, or illegal activity;
  • You no longer meet the eligibility requirements set out in Section 2; or
  • Tamu discontinues the Creator Program or any part of it.

Upon termination for a violation of this Agreement or for fraudulent conduct, any outstanding Creator Balance, including held reserves, may be forfeited in full. Where termination is not due to your fault (e.g. program discontinuation), any earned balance that has cleared the reserve period will be paid out to your verified payout method within 30 days.

You may voluntarily withdraw from the Creator Program at any time via your account settings. Voluntary withdrawal does not affect any earned balance that is not subject to dispute or hold.

9. Tax Responsibility

You are solely responsible for determining, reporting, and paying all taxes applicable to your Creator earnings in your jurisdiction, including but not limited to income tax, value-added tax (VAT), and digital services tax.

Tamu may be required by law to withhold taxes from your earnings. For example, Tamu currently withholds a 5% Digital Service Tax ("DST") on earnings attributed to Kenyan-resident Creators, in accordance with applicable Kenyan law. Withholding rates may vary by jurisdiction and are subject to change as tax laws evolve.

Upon request, Tamu will provide monthly earning statements and, where applicable, tax invoices or withholding certificates that you may use for your own tax reporting purposes. It is your responsibility to maintain accurate records of your Tamu income and to seek independent tax advice if required.
